1. DEFINITION AND SCOPE OF THE CONTRACT
1.1 - This contract ("Contract") is a distance contract pursuant to art. 50 et seq. Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). The Contract relates to the sale of movable goods between a Mag S.r.l. store, with registered office in SEE DATA IN THE ADVERTISEMENTS ("Mag S.r.l.") and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Mag S.r.l. of a purchase proposal issued by the Customer by telephone or via the internet, on the website http://www.Mag S.r.l.shop.it/ (the "Site") and/or through other distance selling systems of Mag S.r.l., on the basis of the methods described in the following article 3.
1.2 - These general conditions of sale ("General Conditions") and, in particular, the information pursuant to art. 52 of the Consumer Code, as provided by Mag S.r.l., repeated over the phone to the Customer and reported on the Site, will remain valid and effective until they are modified and/or integrated by Mag S.r.l.. Any changes and/or additions to the General Conditions will be effective with effect from the date on which they will be communicated to the public and will apply to sales made after that date. The latest updated version of the General Conditions is the one available on the Site.
2. PRICES, PHOTOS AND DESCRIPTIONS
The sales prices of the products illustrated on the Site and/or through any other distance selling systems of Mag S.r.l. are inclusive of taxes and all other taxes. For Italian operators who need an invoice, the prices must be recalculated with 22% VAT. Delivery costs are indicated on the Site and/or through any other distance selling systems of Mag S.r.l. and, in the case of a telephone order, repeated to the Customer by the operator Mag S.r.l..
The photos do not always portray the real product sold, but they are demonstrative, you must always check the title and description.
All the data published in the announcements are considered valid, except for errors and omissions in transcription, in the title, in the price , in the quantity, in the description or in the photo
3. PURCHASE AND PAYMENT METHODS
3.1 - The Contract by telephone is finalized by communicating to the Customer (who has contacted Mag S.r.l. by telephone and formulated, on that occasion, a purchase proposal also providing the operator with the data necessary for the registration procedure of the name, the purchase order and the chosen payment method) that the proposal is accepted.
3.2 - In the case of purchase proposals sent via the Website, the Customer will receive from Mag S.r.l. a summary e-mail, with which he will be informed that his purchase proposal is being processed and will be considered accepted, unless otherwise communicated by e-mail or telephone sent by Mag S.r.l. within 3 (three) calendar days of receipt of the summary e-mail. Once this term has elapsed, the Internet Contract is to be considered completed.
3.3 - The Customer will be allowed to choose one of the following payment methods: any means of payment indicated from time to time as valid by Mag S.r.l. on the Site.
3.4 - Pre-order products, Mag S.r.l. accepts the booking of products that will be made available by the producers or distributors on the indicative dates communicated by them and shown in the product sheet. Delivery times are indicative and may vary without notice and will be made visible on the site according to the updates received.
3.5 - Cancellation of orders, the customer can request the cancellation of an order before it is shipped, Mag S.r.l. will cancel the order and issue a refund within 7 working days of the request, which must be sent in writing via email or site contacts. The refund amount will be net of the expenses incurred by Mag S.r.l., for reasons not attributable to the seller, in the case of pre-orders, the shift of the distribution date is not attributable to the seller, as detailed in the information page. 5% will be withheld from the refund if the payment was made by pay pal or by installment payment or other credit card payments, 5 euros if paid by bank transfer or on delivery. In the case of a pre-order, the prolongation of the wait or the rethinking for personal reasons are not reasons attributable to the seller and the above conditions will be applied for the issue of the refund.
4. DELIVERY OF PRODUCTS - COMPLAINTS
4.1 - Mag S.r.l. delivers the products to the address indicated by the Customer, via a recognized national courier.
4.2 - Any complaint concerning the purchase of a product can be forwarded to the reference address present in the description of the object sold no later than 48 hours from receipt of the package.
4.3 - The Customer can optionally request insurance for the package, if Mag S.r.l. is not requested. will not be responsible for any damage resulting from transport, loss or non-delivery. If the order insurance is activated, upon receipt of the package a reserve signature will be affixed in order to activate the reimbursement procedures in case the product arrives damaged. In case of problems or disputes with the courier, Mag S.r.l. it will limit itself to providing support to the customer to obtain all the information relating to their order and their shipment. The customer remains obliged to send a report within 48 hours of delivery, so as to start management practices with the courier.
4.4 - Mag S.r.l. will deliver the products ordered in the requested quantities, in the event of stock or shipping errors, a refund will be issued for the value of the product not delivered or canceled due to unavailability.
4.5 - Delivery times are indicated in the individual product sheets, a multiple order takes the times of the item with slower delivery. Delivery times are purely indicative, , the dates are indicative and depend on the courier's local branch and the period, the customer may refuse the package if the dates are extended beyond 3 working days. p>
4.6 - Order cancellation or refund requests must be made only from the contact us section of the site, so that it remains registered in the system. Requests arriving by mail or by telephone will not be accepted.
4.7 - All product reports will be verified via email by means of photos, signs or imperfections on the products, they will also be evaluated according to the value of the article. Small marks or slight imperfections will not be considered cause for withdrawal from the purchase. Any request for a return or replacement is to be considered the responsibility of the customer.
4.8 - If the customer is not satisfied with the product received, for any reason, he can exercise the right of withdrawal as per point 8 of the terms and conditions.
5. PRODUCT AVAILABILITY
5.1 - Mag S.r.l. accepts the Customer's orders within the limits of the quantities of the requested products existing in the warehouse. Therefore, the acceptance by Mag S.r.l. of the purchase proposal forwarded by the Customer is subject to the availability of the products in stock. Mag S.r.l. undertakes to promptly notify the Customer of any unforeseeable out-of-stocks due to excess demand or other causes.

6. GUARANTEES AND ASSISTANCE
For the products purchased by the Customer, Mag S.r.l. the rules on guarantees and assistance relating to the sale of consumer goods.
7. CUSTOMER'S OBLIGATIONS
The Customer declares and guarantees: to be a consumer in accordance with the provisions of art. 3 of the Consumer Code; to be of age; that the data provided by the same for the execution of the Contract are correct and truthful.
8. RIGHT OF WITHDRAWAL
8.1 - The sale is assisted by the guarantees for faults and defects established by law. Pursuant to Article 53 of Legislative Decree 6 September 2005 No. 206, if the Customer is a consumer, he has the right to withdraw from the purchase contract for any reason and without providing explanations. To exercise this right, the customer must send a written communication within 10 working days from the date of receipt of the goods. The communication must be addressed, with prior warning, via email to the shop from which the purchase was made. The goods must then be returned at the Customer's care and expense within 10 days from the date of receipt of the goods, to the shop from which the purchase was made. We will refund the entire amount paid (excluding shipping costs) after having ascertained the integrity of the goods. 8.2 - The Customer who intends to exercise the right of withdrawal must return the products to:

Within 14 days of receipt of the products. Pursuant to article 55, second paragraph, of the Consumer Code, the Customer will not have the right of withdrawal in the following cases:
- supply of audiovisual products or sealed software, opened by the Customer;
- supply of products made to measure or customized, or which by their very nature cannot be returned or are likely to deteriorate or expire rapidly (e.g. cosmetics, flowers, foodstuffs);
- supply of newspapers, periodicals and magazines.
- supply of collector's items for which the seals of the original packaging have been opened.
8.3 - Mag S.r.l. will issue a refund of the amount paid by the customer, within 14 days from the date of receipt of the returned products: the full price paid by the customer, in case of return of the product complete with all its parts and functionality and original sealed box; or the part of the price equivalent to the product actually returned by the Customer who has consumed the product in an appreciable way and/or such as to significantly diminish its value.
8.4 - In case of change of mind by the customer, before the purchased product is shipped, Mag S.r.l., upon written request from the customer, will cancel the order and issue a refund net of all expenses that Mag S.r.l. will support for the issuance of the refund itself:
- in the event of a refund by bank transfer, the cost required by the bank for issuing the transfer will be deducted;
- in case of reimbursement through other payment systems, the commission paid by Mag S.r.l. will be deducted. in the system used by the customer;
8.5 - If the product is returned damaged, with missing parts, without its original box, the return will be refused and no refund of the amount paid will be accepted. The item can be collected by the customer, at his expense, within 30 days, after this date the product will be disposed of.
8.6 - The refund of the amount paid will be made in the same way in which the customer made the payment at the time of purchase, except for payment on delivery which will be refunded by bank transfer. The refund amount will be net of expenses in cases where the customer decides to return the product for reasons not attributable to the seller, 5% will be retained if the payment was made with any online system or bank commissions to issue the refund . In case of payment on delivery, the outward fees will not be refunded.
8.7 - Packaging and boxes damaged by transport, Mag S.r.l. pay close attention to checking the products before shipping and to the packaging in order to prevent the products from being damaged. However, the product packaging is specially designed to protect the product inside the package from any transport damage such as tears, holes, dents or any sign present in the box/s , if the customer has not chosen the insurance option and signed with reserve upon receipt, they will not be replaced or refunded and the return request will not be accepted.

8.8 - Mag S.r.l. carefully check each product before it is shipped, and contact each customer to get authorization to ship an item that has damaged packaging, even before shipping, by mail or telephone. In the event that the customer accepts the shipment of the product with a damaged box, it will not be possible to request a return after receiving it, and no partial refunds will be granted.
9. TREATMENT AND CONFIDENTIALITY OF PERSONAL DATA INFORMATION PURSUANT TO D.LGS. 196/03
9.1 - Pursuant to and for the purposes of the provisions of Legislative Decree No. 196 of 30 June 2003, Code regarding the protection of personal data (hereinafter the "Code"), we inform you that your personal data , supplied and/or acquired subsequently, will be processed by Mag S.r.l., in Italy and abroad, through electronic and manual tools in compliance with the Code and current legislation on privacy.
Purpose of processing
The data collected is processed for the following purposes: a. subscribe to the service; b. conclude purchase and sale contracts and carry out their performance; c. carry out the fulfilments necessary to execute the contractual relationship in place; d. send commercial information, advertising, informative and promotional material, by any means (email, sms, etc.); And. carry out, also by telephone contact, market research, economic and statistical analyzes in order to verify the correct functioning of the services and their approval; f. process personalized information about the consumption habits and orientation of the interested parties; g. communicate the data to third-party companies for direct marketing purposes. The provision of data is mandatory for the conclusion of the purchase contract, optional in other cases. Failure to provide data will make it impossible to carry out the order.
Data retention
All the data acquired cannot be used for other purposes than those indicated above and will be kept for the period necessary for the realization of the same. After this term, the data will be deleted or transformed into anonymous form. For detailed data on purchases and services, storage times will not exceed those established by current legislation.
Rights of the interested party
Without prejudice to your right to exercise the rights referred to in Article 7 (Right of access to personal data and other rights) of the Code at any time, in particular: the right to access your personal data, request rectification, updating and cancellation if incomplete, erroneous or collected in violation of current legislation, as well as to oppose their treatment for legitimate reasons, by sending a written request to the Regulatory and Institutional Compliance Department MAG Srl Via Vivare 119 - 47842 - San Giovanni in Marignano (RN) - Italy, or directly through the methods indicated on the site on the data access page.
